1. Scope & Subject Matter
These Terms of Service apply to the use of the Lemoyn community platform (website and related services, hereinafter the “Platform”), operated by:

Lemoyn is a community-based directory of mountain bike spots (bike parks, trails, pump tracks, etc.) featuring reviews, video clips and editorial content. Use of the Platform is free of charge for private end users. There is no claim to permanent availability. Commercial partners (e.g. operators, shops, hotels) may agree on paid services separately (see section 7).
2. User Accounts & Registration
- Certain features (e.g. reviews, clip uploads, favourites) require a free user account.
- Registration is permitted to natural persons aged 16 and over. Younger persons may use the Platform only with the consent of their legal guardians.
- The information provided upon registration must be truthful and up to date. Login credentials must be kept confidential; the user is responsible for actions taken via their account.
- Users can delete their account, including all personal data, at any time in the account settings. We may suspend or delete accounts that breach these Terms.
3. User-Generated Content (Clips & Reviews)
You retain all copyright and related rights in the content you upload (video clips, text, reviews). By uploading, you grant Lemoyn a non-exclusive, worldwide, royalty-free right, limited to the duration of publication, to store, reproduce, make publicly available and display this content for operating and promoting the Platform — including use on the Platform’s social media channels.
You warrant that you hold the necessary rights and that identifiable persons have consented to publication. Prohibited content includes, in particular, unlawful, violence-glorifying, offensive, discriminatory, youth-endangering content or content infringing third-party rights, as well as unsolicited advertising and spam.
We are entitled to review content and to remove it in the event of violations or upon a justified report. You can report unlawful content at any time by email to hallo@lemoyn.com (notice-and-action procedure pursuant to the Digital Services Act).
4. Third-Party Content & Accuracy of Information
Spot information (e.g. trails, difficulty ratings, opening hours, lifts) is contributed partly editorially and partly by the community. We strive for accuracy and timeliness but assume no warranty for completeness and correctness. Mountain biking is at your own risk; always verify conditions, closures and access on site with the respective official source.
5. Liability
We are liable without limitation for damages arising from injury to life, body or health and for intent and gross negligence. In the case of slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract; otherwise liability is excluded. We assume no liability for user-generated content or for the content of linked external third-party websites; the respective provider is responsible in this regard. Mandatory provisions of product liability and consumer protection law remain unaffected.
6. User Obligations
The Platform must not be used improperly. In particular, the automated extraction of content (scraping) without consent, interference with the technical infrastructure, circumvention of security measures, and the posting of false or misleading spot or review information are prohibited.
7. Commercial Partners
Separate contractual agreements apply additionally to commercial partners (e.g. bike park operators, shops, hotels), governing the scope of services, term and remuneration. No costs arise for consumers from using the Platform.
8. Changes to These Terms
We may amend these Terms with effect for the future where this is necessary for valid reasons (e.g. changed legal situation, new features). We will inform registered users of material changes within a reasonable period; continued use after they take effect constitutes acceptance.
9. Governing Law & Jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and conflict-of-law provisions. For consumers, the mandatory protective provisions of their country of residence remain unaffected. In relation to businesses, the court with subject-matter jurisdiction for the operator’s registered seat is the exclusive place of jurisdiction.
10. Final Provisions
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The EU online dispute resolution platform is available at ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
